At Happiness Locked LLC (“Happiness Locked,” “we,” “our” or “us”), your privacy is important to us, and we want to make sure you know the “what”, the “why” and the “how” of all the information we collect through our users and visitors. In this privacy policy (“Policy”), we explain:

To Whom This Privacy Policy Applies

This Policy explains the treatment of your information through Happiness Locked’s web properties, including without limitation happinesslocked.com and any other web-based platform, content creation tool, or website under Happiness Locked’s control, whether now existing or in the future (collectively referred to as “Website(s)”) and ticket protection service (collectively, the “Service”), whether now existing or in the future. The privacy practices described in this Policy apply to you if you a visitor, customer, or affiliate of a customer.

If you do not agree with the data practices described in this Policy, you should not use the Service or visit our Websites. We may from time-to-time update, amend or modify the terms of this Policy, and post the updated version to our Websites. If there is a material change to the information we collect, process or your data rights, we will notify you of the amendment or update by email or other direct communication that you’ve opted into or consented to. Your continued use of the Service after any amendment or update to this Policy shall constitute immediate acceptance of all revised, modified and/or amended terms to this Policy. However, you should review the most up-to-date version of the Policy from time-to-time on the Websites.

Nothing in this Policy shall be deemed to confer any third-party rights or benefits. Our partners, affiliates, vendors, manufacturers, distributors, licensors and/or third-party websites may have additional privacy policy terms, restrictions, limitations and data collection and protection practices that you should review separately and independently from this Policy. We are not liable for the data collection, storage and usage practices of any third-party affiliate, vendor, licensor or the like.

This Policy constitutes a binding agreement between you and us. By accessing and/or using the Service, either through the Websites or integration with other sites and tools, you agree to the terms of this Policy.

What is Personal Information?

As used in this Policy, “Personal Information,” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal Information falls within certain categories, for example:

  • Identifiers (e.g., name, email, telephone number, address, username);

  • Sensitive information (e.g., government ID, health data, precise geolocation, racial/ethnic origin, religious beliefs, contents of messages when we are not the recipient, information about a known child);

  • Legally protected information (e.g., race, citizenship, marital status, sex);

  • Employment-related information (e.g., current or past employment);

  • Non-public educational information, including information protected under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g, 34 C.F.R. Part 99);

  • Biometrics (e.g., DNA, face/voice prints, health data) and audio, electronic, visual, thermal, or olfactory information;

  • Commercial history (e.g., products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies);

  • Internet or other similar activity (e.g., browsing history; content interactions); and

  • Inferences drawn from Personal Information to create a profile about preferences, characteristics, trends, predispositions, behavior, attitudes, intelligence, and aptitudes.

Please note that not all information about you is Personal Information. Information that is often exempted from privacy law protection includes publicly available information, aggregated information (meaning data summaries or reports with Personal Information removed), and anonymized information that cannot be linked back to an individual.  

Information We Collect, How & Why

To provide the Service, we will need to collect certain Personal Information. We collect and process Personal Information with your consent, to fulfil our contractual obligations to you, to achieve our legitimate interests, or as required or permitted by law. We only collect Personal Information as reasonable and necessary and only with your consent, with a legitimate interest, or as authorized or required by law.  While our needs to use Personal Information may change, either because of the nature of your use of our Service or our updates to the technology operating the Service, we will continue to collect only what is reasonable and necessary and only with your consent.

In the preceding 12 months, we have collected Personal Information in the categories of identifiers, commercial history, and internet and similar information. We collect Personal Information that you voluntarily provide to us when you:

  • Create an account to use the Service. To create your account, we will collect your full name, email address, phone number, physical address, password, and events you have tickets for. We collect and process this information with your consent to provide you with the Service.

  • Use the Service. When you use the Services, we collect commercial history and internet and similar information related to your ticket protection requests and other uses of the Service. We collect and process this information to achieve our legitimate interest of providing you with the Service as you request. Additionally, we may use cookies to collect technical data about your use of the Services (e.g., IP address, device ID, operating system, browser type, and language) or general information about your location. We collect this information for our legitimate interest in understanding and improving your experience using the Service. We may use cookies and related technologies to collect and process some of this data. To learn more, see the Cookies section.

  • Contact Happiness Locked. If you contact us, we will collect identifiers like your email and name and any details you include in your message to us. We collect and process this information to respond to your request and to improve the Service.

In addition to the specific uses described above, Happiness Locked might use the Personal Information collected through the Service to (i) protect your privacy and enforce this Policy; (ii) comply with a law, regulation, legal process, or court order; (iii) monitor your compliance with any of your agreements with Happiness Locked; (iv) if we believe it is necessary, to identify, contact or bring legal action against persons or entities who may be causing injury to you, to us, or to others; or (v) fulfill any other purpose to which you consent.

Cookies

Like many websites, Happiness Locked may use a standard technology called a "cookie" to collect information about how you use our Website, remember your identity and user information while providing the Service, and understand user traffic patterns and usage of the Service. A cookie is a small data file that certain websites write to your hard drive when you visit them to track your content interactions, remember your preferences, or perform other functions.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Service.

Examples of Cookies we use:

  • Session Cookies. We use Session Cookies to operate our Service.

  • Preference Cookies. We use Preference Cookies to remember your preferences and various settings.

  • Security Cookies. We use Security Cookies for security purposes.

Children’s Privacy

The Service is for adults, not children. You must be at least 18 years old to create an account and use the Service. Happiness Locked does not knowingly collect any Personal Information from children under the age of 18. If we become aware that a Minor has registered under an inaccurate age or that a Minor has provided us with Personal Information without Guardian consent, we will delete any Personal Information we have collected, unless we have a legal obligation to keep it and terminate the Minor’s account. Payments

All payment data is processed and stored by a secure third-party payment gateway, such as Stripe or Auth. We are not responsible for the privacy policies of our third-party payment gateways as it relates to data like payment data that does not reside on our servers, so please read their policies carefully. We may keep small amounts of data, such as the last four numbers of a credit card, for limited purposes such as to identify whether the card you’ve provided has been used in a prior transaction.

Disclosure of Information

Happiness Locked only discloses Personal Information collected through the Service with your permission or as described in this section. Any Personal Information we collect about you may be disclosed to the recipients described below.

 

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service.

  • Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.

You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

Third-Party Features

The Services may contain third-party features like social media interaction tools or advertising provided by social media or advertising partners. If you use a third-party feature available in the Services (e.g., liking, sharing, logging in) or if you interact with an ad on the Services, both we and that third party may have access to your Personal Information associated with your use of that feature. The third parties offering these features may use cookies and other tracking technologies to access your Personal Information and other data related to your device and use of the Services. You should carefully review the third party’s privacy policy and terms of use.

Legally Required or Permitted.

We may disclose the Personal Information we collect to our affiliates or subsidiaries. If we do disclose your Personal Information to an affiliate or subsidiary, their use and disclosure of your Personal Information will be subject to this Privacy Policy.

We may disclose your Personal Information to law enforcement and other governmental agencies, as permitted or required by law.

We may disclose Personal Information to others as permitted by applicable law, for example: if we go through a business transition (e.g., merger, acquisition, or sale of a portion of our assets); to comply with a legal requirement or a court order; when we believe it is appropriate in order to take action regarding illegal activities or prevent fraud or harm to any person; to exercise or defend our legal claims; or for any other reason with your consent.

No Sale or Sharing.

Happiness Locked does not sell or share (as those terms are defined in privacy laws) or license, or otherwise share your Personal Information or any personally identifiable information with any entity or person, except as expressly described in this Policy or when we have a legal basis to do so, for instance with your prior written consent or a court order.

Aggregated and Deidentified Information.

Happiness Locked reserves the right to share aggregated, anonymized, or de-identified information about any individuals with nonaffiliated entities for marketing, advertising, research, or other purposes, without restriction.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

 

Data Retention Practices

We will only keep Your Personal Information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your Data, we will either delete, de-identify it or anonymize it. If this is not possible (for example, because your Data has been stored in backup archives), then we will securely store your Data and isolate it from any further processing until deletion is possible.

If you have elected to receive marketing communications from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our content or Service, such as when you last logged into your User Account. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.

  • Privacy Requests. If you would like assistance with your account, request information, express concerns, lodge a complaint, or wish to exercise your privacy rights (described below), please submit a request by email to [privacy@happinesslocked.com]. Your request must (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personally Identifiable Information or an authorized representative, and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. Happiness Locked can only fulfill a request when we have sufficient information to verify that the requester is the person or an authorized representative of the person about whom we have collected Personal Information, and to properly understand, evaluate, and respond to the request. Happiness Locked will try to respond within the legally required timelines. If we need more time, we will contact you. Statutory exceptions and limitations may apply. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell You why we made that decision and provide you with a cost estimate before completing your request.

  • Do Not Track. Do Not Track signals are signals sent through a browser informing us that you do not want to be tracked. Currently, our systems do not recognize browser “do-not-track” requests. If this changes in the future, we will update this Privacy Policy.

 

Your Privacy Rights

This section provides informational notices pursuant to consumer privacy laws that require companies to inform consumers about their privacy rights. Some of these laws may not apply to you or your access to or use of the Services, in which case these notices are offered as a courtesy. Happiness Locked’s obligations under these laws are limited to the extent Happiness Locked collects or processes your Personal Information via the Services and are subject to the applicable statutory exceptions and limitations. Depending on where you live, your rights over your Personal Information may include some or all of the following privacy rights:

  • Right to deletion. When you cancel your account, the Personal Information associated with your account is automatically scheduled for deletion within 30 days. Additionally, upon your request and when required by law, we will delete your Personal Information from our systems. This right is not absolute, and we may be entitled to retain and process your Personal Information despite your request. If you make this request, we balance certain legal, contractual, and business interests against your right to request the deletion of your Personal Information.

  • Right to accuracy, and the right to correct your Personal Information. You can correct or update your Personal Information through your account. If you require assistance, please contact us at privacy@happinesslocked.com and we will update our records to reflect your accurate information.

  • Right to know. You may have the right to know how Happiness Locked collects and processes your Personal Information. We have set the required information in this Privacy Policy. Happiness Locked may provide you with additional notices about other ways we process your Personal Information, such as by sending you a notice via the Services, email, or other communication.

  • Right to access your Personal Information. You can access your Personal Information through your account. Additionally, we will provide you with a copy of your Personal Information upon request, along with details about the types of Personal Information we process, why we process it, and any third parties we work with to collect Personal Information on our behalf. We may have one or more legally valid reasons to refuse your request in whole or in part, for example, to protect the rights of other individuals. Certain laws may limit the scope or frequency of requests we must fulfill.  

  • Right to reasonable expectations. You can expect Happiness Locked to collect, use, or disclose Personal Information collected through the Services responsibly and not for any other purpose other than as stated at the time of collection. Happiness Locked set your expectations in this Privacy Policy, and we collect legally required consent at various stages of our interactions with you. If we collect or use your Personal Information based on your consent, we will also notify you of any changes and will request your further consent as required by law. You may withdraw your consent at any time with reasonable notice by contacting privacy@happinesslocked.com

  • Right to data portability. In some cases, we are required to provide your Personal Information to another organization at your request and in a structured, commonly used machine-readable format, so that the other organization can read and use it.

  • No selling or sharing Personal Information. Some jurisdictions entitle consumers to opt out of the sale or sharing of their Personal Information or targeted advertising practices. Happiness Locked does not sell your Personal Information or share your Personal Information with third parties for cross-contextual behavioral advertising purposes.

  • Right to non-discrimination. If you reside in a jurisdiction that extends a right to non-discrimination related to the exercise of privacy rights, we will not (i) deny you goods or services, (ii) charge you different prices or rates for goods or services, (iii) provide you a different level or quality of goods or services, (iv) retaliate against you as an employee, applicant for employment, or independent contractor; or (v) suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services, because you exercised your statutory right unless permitted by law.

  • Right to disclosure of certain information. You may have a right to request information about our collection and use of your Personal Information over the past 12 months, such as (i) the categories of Personal Information we have collected about you; (ii) the categories of sources for the Personal Information we have collected about you; (iii) our business purpose for collecting, using, disclosing, or selling that Personal Information, as applicable; and (iv) the categories of third parties with whom we disclose that Personal Information. Happiness Locked does not sell or share your Personal Information, but if we did you could request two separate lists stating: (a) sales, identifying the Personal Information categories that each category of recipient purchased; and (b) sharing for a business purpose, identifying the Personal Information categories that each category of recipient obtained. Certain laws may limit the number or frequency of requests we must fulfill.   

  • Health Data Rights. Happiness Locked collects limited health data from users. Some laws entitle consumers to certain details about health data collected about them, including (i) confirmation of whether the entity collects, shares, or sells the consumer’s health data and access that data, including a list of all third parties and affiliates with whom the entity has shared or sold the health data and a method to contact those third parties, (ii) a method to withdraw consent related to use of health data, and (iii) the right to have their health data be deleted.

  • Right to not be subject to automated decision-making and the right to opt out of profiling. Happiness Locked does not use automated decision-making or any form of automated processing of Personal Information to evaluate, analyze, or predict your performance, preferences, choices, or behavior.

  • Right to restrict processing. You may have the right to request that we restrict the processing of your Personal Information if (i) the data is inaccurate, (ii) the processing is unlawful, (iii) we no longer need the Personal Information, or (iv) you exercise your right to object. Your right to restrict may be limited to Personal Information that is sensitive in nature, or that is sold or shared for certain purposes.

  • Right to object. You may have the right to request, under certain circumstances and where we are required to do so by law, that we limit our processing of your Personal Information as you request.

  • Right to disclosure of marketing information. If you are a resident of the State of California, California’s Shine the Light Act (Civil Code sections 1798.83-1798.84) entitles California consumers to request certain disclosures regarding Personal Information sharing with affiliates and/or third parties for marketing purposes.

 

Cross-Border Data Transfers

Happiness Locked provides the Services from our offices in the United States. If you access the Services from outside the United States, please be aware that your Personal Information may be transferred to, processed, stored, and used in the United States or other jurisdictions. Happiness Locked is committed to transferring Personal Information via an adequacy decision, standard contractual clauses, or other lawful data transfer mechanism. When your data is moved from your home country to another country, the laws and rules that protect your Personal Information in the country to which your information is transferred may be different from those of the country where you live. For example, if your information is in the United States, it may be accessed by government authorities under United States law. Happiness Locked does not warrant that the Services are appropriate or authorized for use in any other jurisdictions. You are solely responsible for determining whether the Services comply with the laws that apply to you. By allowing us to collect Personal Information about you, you consent to the transfer and processing of your Personal Information as described in this section.
